§ 1 Scope & Provider

These terms and conditions apply to purchases made through the smartvalid.de online shop (smartvalid. brand) with:

§ 2 Conclusion of Contract

The product presentation is an invitation to place an order. By submitting your order, you are making a binding offer. The contract is concluded with our acceptance (order/shipping confirmation or delivery).

§ 3 Language & Contract Text

The contract language is German. The general terms and conditions, cancellation policy and privacy policy can be accessed in the shop.

§ 4 Prices & Shipping Costs

Prices are total prices including VAT. Shipping costs are displayed before the order is placed. Details: Shipping & Payment.

§ 5 Delivery

Delivery by shipping within DE/EU according to shop information. No self-collection. If unavailable, we will inform you; payments will be refunded immediately.

§ 6 Payment

The selection shown in the checkout is decisive.

§ 7 Retention of Title

The goods remain our property until full payment has been made.

§ 8 Cancellation

Consumers have a right of cancellation. Details in the cancellation policy.

§ 9 Liability for Defects

The statutory liability for defects applies. For consumers: 2 years from delivery for new goods.

§ 10 Liability

Unlimited liability for intent, gross negligence, product liability, and injury to life, body, and health. In cases of slight negligence regarding essential duties: liability is limited to typical, foreseeable damage; otherwise excluded.

§ 11 Dispute Resolution

OS platform: https://ec.europa.eu/consumers/odr/. No participation in consumer arbitration.

§ 12 Final Provisions

German law applies, excluding the CISG; mandatory consumer protection at the place of residence remains unaffected. The invalidity of individual clauses does not affect the rest.
